Terms of Use (ToU)

1. General Information

These Terms of Use ("Terms", "ToU") govern your use of the MyBuddyDiary mobile application as well as any associated website (the "Service"), operated by CSMGAUSSIN / MYBUDDYDIARY ("we", "us", "our"). By accessing or using the Service, you unconditionally agree to these Terms. If you do not agree with any part of them, you must stop using the Service.

2. Eligibility

Use of the Service is strictly reserved for individuals aged 15 or older. By creating an account or using the Service, you declare that you are at least 15 years old. Individuals under the age of 15 are not permitted to use MyBuddyDiary.

3. Accounts

When creating an account, you agree to provide accurate, complete, and up-to-date information. Failure to do so constitutes a violation of these Terms and may result in immediate suspension or deletion of your account. You are solely responsible for:

• keeping your password confidential,
• any activity carried out through your account,
• immediately reporting any unauthorized use of your account.

4. Content

The Service allows users to publish text, images, and other elements related to animals ("Content"). You are fully responsible for the Content you publish, including:

• its legality,
• its accuracy,
• its respect for privacy and third-party rights,
• its appropriateness.

By posting Content on MyBuddyDiary, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, display, and distribute this Content within the scope of the Service. You remain the owner of your Content. You guarantee that:

1. You hold the necessary rights to publish this Content;

2. The Content does not infringe any rights (copyright, trademark, privacy, contract, etc.);

3. The Content complies with French and European laws, including rules regarding the protection of minors, animal welfare, and defamation.

We reserve the right to remove any Content deemed inappropriate, dangerous, illegal, or non-compliant with these Terms.

5. Geolocation and Map Features

MyBuddyDiary offers a map that displays nearby animals, users, and content. By using these features, you agree to the use of your geolocation data in accordance with our Privacy Policy. You are responsible for:

• the accuracy of your location data,
• not disclosing private addresses of third parties,
• not endangering other people or animals.

6. Professional Accounts

The Service accepts registrations from professionals and organizations in the animal field: veterinarians, trainers, shelters, associations, breeders. Professional accounts must:

• provide truthful and verifiable information,
• not impersonate a professional status,
• comply with applicable French and European laws.

Any falsification may result in account termination.

7. Copyright Policy

We respect intellectual property rights. If you believe that Content on MyBuddyDiary infringes your copyright, please send a written notice to: contact@mybuddydiary.com / Subject: “Copyright Infringement”. Your notice must include all necessary information to identify the alleged violation. Any false claim may result in civil liability.

8. Intellectual Property

The Service, its interface, source code, features, and all elements not originating from users are the exclusive property of CSMGAUSSIN / MYBUDDYDIARY or its partners. Any reproduction or use without written authorization is strictly prohibited.

9. Links to Third-Party Sites

MyBuddyDiary may contain links to third-party sites or services. CSMGAUSSIN / MYBUDDYDIARY has no control over these sites and assumes no responsibility for:

• their content,
• their privacy policies,
• their practices.

We recommend reading their terms of use and privacy policies carefully.

10. Termination

We may suspend or delete your account immediately and without notice in the event of:

• non-compliance with the ToU,
• harmful behavior,
• publication of illegal or dangerous Content.

You may terminate your account at any time by stopping the use of the Service or by deleting your account through the application.

11. Availability, Errors, and Inaccuracies

The Service is regularly updated. However, it may contain errors, omissions, or inaccuracies. We do not guarantee the accuracy of the information available on MyBuddyDiary. We reserve the right to correct, modify, or update any information at any time.

12. Limitation of Liability

CSMGAUSSIN / MYBUDDYDIARY and its employees, partners, and suppliers cannot be held liable for any indirect, consequential, or intangible damages arising from:

• your use or inability to use MyBuddyDiary,
• the behavior of other users,
• Content obtained through the Service,
• unauthorized access to your data,
• potential errors, interruptions, or bugs.

This limitation applies under French law.

13. Disclaimer of Warranty

The Service is provided "AS IS" and "AS AVAILABLE". We do not guarantee that:

• the Service will operate without interruption,
• errors will be corrected,
• the Service is free of viruses or harmful elements,
• results will meet your expectations.

14. Governing Law

These Terms are governed by French law. If any provision is deemed invalid, the remaining provisions shall remain fully effective. These Terms constitute the entire agreement between the user and CSMGAUSSIN / MYBUDDYDIARY.

15. Changes to the Terms

We may modify these Terms at any time. Significant changes will be subject to reasonable notice. By continuing to use MyBuddyDiary after updates to the Terms, you accept the new conditions.
